1. Acceptance of Terms

By accessing or using ErrandPal ("the Platform", "we", "us", or "our"), operated by Errand Pal Global Ltd, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

ErrandPal is a platform that connects users with verified agents who can assist with various errands and tasks. We do not provide delivery or pickup services.

2. Eligibility and Age Requirements

2.1 Minimum Age

  • • You must be at least 18 years of age to use ErrandPal as either a User or an Agent.
  • • By using our Platform, you represent and warrant that you are at least 18 years old.
  • • We reserve the right to request proof of age at any time.

2.2 Account Verification

  • • All users must complete our verification process before accessing the Platform.
  • • Agents must undergo additional background checks and identity verification.
  • • Providing false information during verification is grounds for immediate account termination.

3. Account Registration and Security

3.1 Account Creation

  • • You must provide accurate, current, and complete information during registration.
  • • You are responsible for maintaining the confidentiality of your account credentials.
  • • You must notify us immediately of any unauthorized access to your account.

3.2 Account Verification Requirements

  • • Valid government-issued photo identification
  • • Verified phone number and email address
  • • For Agents: Background check clearance and additional documentation as required
  • • Proof of address verification

3.3 One Account Per Person

  • • Each individual may maintain only one active account on the Platform.
  • • Multiple accounts created by the same person will be subject to suspension or termination.

4. Prohibited Activities and Content

4.1 Prohibited Errand Requests

Users are strictly prohibited from requesting errands involving:

  • • Illegal substances, drugs, or controlled substances
  • • Weapons, firearms, or explosives
  • • Pornographic or sexually explicit materials
  • • Stolen goods or items
  • • Prescription medications (unless properly authorized)
  • • Tobacco products for minors
  • • Alcohol for minors
  • • Any illegal or fraudulent activities
  • • Items that violate intellectual property rights
  • • Delivery or transportation services (not offered by our platform)

4.2 Prohibited Behavior

The following behaviors are strictly forbidden:

  • • Harassment, threats, or abusive language toward Agents or Users
  • • Sexual harassment or inappropriate sexual conduct
  • • Discrimination based on race, religion, gender, sexual orientation, disability, or any protected class
  • • Fraudulent activities or payment disputes made in bad faith
  • • Attempting to circumvent the Platform to conduct direct transactions
  • • Sharing contact information to arrange off-platform services
  • • Using the Platform for any illegal purpose

4.3 Sexual Content and Conduct

  • Zero tolerance policy: Any requests for, solicitation of, or engagement in sexual services or content will result in immediate account termination and may be reported to law enforcement.
  • • Users and Agents must not engage in any sexually suggestive communication or behavior.
  • • Inappropriate comments, advances, or requests of a sexual nature are strictly prohibited.

5. User Responsibilities

5.1 As a User (Customer)

  • • Provide clear, accurate task descriptions
  • • Set reasonable budgets and timelines
  • • Be available for communication during errand completion
  • • Ensure safe access to service locations when required
  • • Treat Agents with respect and professionalism
  • • Pay for services as agreed

5.2 As an Agent (Service Provider)

  • • Complete errands as described and agreed upon
  • • Maintain professional conduct at all times
  • • Provide accurate updates and GPS tracking
  • • Handle items with care and responsibility
  • • Follow all applicable laws and regulations
  • • Maintain active verification status

6. Payment Terms

6.1 Pricing and Fees

  • • Users pay the agreed-upon price for errand services plus applicable platform fees.
  • • All fees are clearly displayed before confirming an errand request.
  • • Payment is processed through the Platform's secure payment system.

6.2 Payment Processing

  • • We use third-party payment processors to handle transactions.
  • • Payment must be completed before errand confirmation.
  • • Tips are optional and go directly to the Agent.

6.3 Refunds and Disputes

  • • Refund requests must be submitted within 48 hours of errand completion.
  • • We will investigate all disputes fairly and in good faith.
  • • Our decision on disputes is final.

7. Agent Background Checks and Verification

7.1 Verification Process

All Agents must complete:

  • • Identity verification with government-issued ID
  • • Background check including criminal history
  • • Reference verification
  • • Ongoing monitoring and re-verification as required

7.2 Disqualifying Factors

Agents may be disqualified for:

  • • Violent criminal history
  • • Sexual offenses
  • • Theft or fraud convictions
  • • Falsified application information
  • • Failure to maintain required standards

8. Platform Safety and GPS Tracking

8.1 Real-Time Tracking

  • • Agents must enable GPS tracking during active errands.
  • • Users can track errand progress in real-time.
  • • Location data is used solely for service delivery and safety.

8.2 Safety Features

  • • In-app messaging system for communication
  • • Emergency contact features
  • • Rating and review system
  • • 24/7 support for safety concerns

9. Ratings and Reviews

9.1 Review System

  • • Users and Agents can rate each other after errand completion.
  • • Reviews must be honest, relevant, and based on actual experience.
  • • Fraudulent, abusive, or retaliatory reviews will be removed.

9.2 Account Impact

  • • Consistently low ratings may result in account restrictions or termination.
  • • We reserve the right to investigate and moderate all reviews.

10. Intellectual Property

10.1 Platform Content

  • • All content on ErrandPal, including logos, designs, text, and software, is owned by us or our licensors.
  • • You may not copy, modify, distribute, or create derivative works without permission.

10.2 User Content

  • • You retain ownership of any content you submit to the Platform.
  • • By submitting content, you grant us a worldwide, non-exclusive license to use it for Platform operations.

11. Limitation of Liability

11.1 Service Availability

  • • ErrandPal is provided "as is" without warranties of any kind.
  • • We do not guarantee uninterrupted or error-free service.
  • • We are not responsible for delays caused by third parties or circumstances beyond our control.

11.2 Liability Cap

  • • To the maximum extent permitted by law, our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
  • • We are not liable for indirect, incidental, special, or consequential damages.

11.3 Agent Relationship

  • • Agents are independent contractors, not employees of ErrandPal.
  • • We facilitate connections but are not responsible for Agent actions or omissions.
  • • Disputes between Users and Agents should be reported through proper channels.

12. Indemnification

You agree to indemnify and hold harmless Errand Pal Global Ltd, ErrandPal, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • • Your use of the Platform
  • • Your violation of these Terms
  • • Your violation of any rights of another party
  • • Your provision of false or misleading information

13. Termination

13.1 By You

  • • You may terminate your account at any time through account settings.
  • • Deletion requests will be processed according to our Privacy Policy.

13.2 By Us

We may suspend or terminate your account immediately if you:

  • • Violate these Terms and Conditions
  • • Engage in prohibited activities
  • • Provide false information
  • • Pose a safety risk to the community
  • • Fail to maintain verification requirements

14. Dispute Resolution

14.1 Informal Resolution

  • • We encourage resolving disputes through customer support first.

14.2 Arbitration Agreement

  • • Any disputes that cannot be resolved informally shall be settled by binding arbitration.
  • • You waive your right to participate in class actions or class arbitrations.

14.3 Exceptions

  • • Either party may seek injunctive relief in court for intellectual property or confidentiality breaches.
  • • Small claims court actions are permitted within jurisdictional limits.

15. Changes to Terms

  • • We reserve the right to modify these Terms at any time.
  • • Material changes will be communicated via email or Platform notification.
  • • Continued use after changes constitutes acceptance of new Terms.
  • • The "Last Updated" date will reflect the most recent revision.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Errand Pal Global Ltd regarding your use of the Platform.
